PRIVACY POLICY

1. Who are we and what is this document about?

We are Cartaseta AG, Sandackerstrasse 3, 5014 Gretzenbach, and Tela GmbH, Rotboden 1, 4704 Niederbipp, the joint controllers of this website. This is our Privacy Policy (“PP”), in which we provide you as a data subject with the information necessary in order for you to be able to exercise your rights, and thus in order to ensure transparent data processing.

This PP establishes the basis upon which we process your personal data as described below, including data that we receive in relation to your usage of and interaction with this website or any other online presence managed by us, as well as our profiles on social media and our applications (“Apps”) (referred to collectively as the “Website”).

We are part of a corporate group, https://tela-cartaseta.ch, which has organised particular processing procedures centrally for the purpose of increasing efficiency, ensuring security and optimising costs (e.g. hosting, IT security, means of communication). This means that the data collected on the Website will be shared within the corporate group in order to enable the group’s internal service providers to perform their designated tasks. Whenever this occurs, data protection requirements are complied with and we remain the point of contact for you.

This Website may contain links to and from the websites of our partner networks, advertising partners and related companies. If you follow a link to one of these websites, please note that each one has its own PP and we cannot be held liable or responsible for them.

2. Which personal data of yours do we process and for what purpose, and with whom do we share them?

2.1. If you visit our website

Whenever our website is visited our servers temporarily store each access in the form of a log file. As part of this process, as is generally the case for any connection with an online server, the following technical data are collected without any involvement by you and are stored by us until they are automatically erased:

  • the IP address of the requesting computer;
  • the name of the holder of the IP address range (normally your internet access provider);
  • the date and time of access;
  • the website from which access has occurred (referrer URL), if appropriate along with the keyword used;
  • the name and URL of the file retrieved;
  • the status code (e.g. error message);
  • your computer’s operating system;
  • the browser used by you (type, version and language);
  • the transmission protocol (e.g. HTTP/1.1).

These data are collected and stored for the purpose of enabling our Website to be used (establishing a connection), ensuring system security and stability on an ongoing basis, enabling our website content to be optimised and for internal statistical purposes.

In this regard, we receive support from our partners, which are in turn subject to data protection rules and which we have carefully selected and duly obliged under contract to comply with data protection rules, in particular in relation to data security.

2.2. If you contact us using the contact form

This Website enables you to contact us using the contact form. If you decide to contact us in this manner, you will be deemed to have consented to us

processing your email address, name, if applicable organisation and telephone number, as well as the content of our conversation for the purpose of communicating with you until we are able to conclude that you are satisfied, following which the data will be archived or erased in accordance with statutory requirements.

2.3. If you contact us by email or telephone

If you decide to contact us by email or telephone, you will be deemed to have consented to us processing your email address, surname, first name, form of address, if applicable organisation and telephone number and if applicable proposed appointment, as well as the content of our conversation for the purpose of communicating with you until we are able to conclude that you are satisfied, following which the data will be archived or erased in accordance with statutory requirements.

2.4. If you participate in any of our events

We arrange events and training sessions for which guests, clients and any people with an interest can register on our Website. If you register, you will be deemed to have consented to us processing your email address, surname, first name, form of address, company name, telephone number and if applicable function and department for the purpose of processing registrations, holding the event and if applicable invoicing, following which the data will be archived or erased in accordance with statutory requirements. We may also share these data with a co-organiser for joint processing or with an agency/partner for processing on our behalf, which will be limited to the purpose of processing your registration and participation in the event. In such cases we remain the point of contact for you.

We arrange events to which guests, customers and any people with an interest are invited. Participants are normally invited by us, although may also be guests of other participants or people who have otherwise heard about our event and decided to take part. We process the data of people with whom we are in direct contact as described in the section on the newsletter, and process the data of other people in the manner necessary for the management of a guest list (if applicable, surname, first name, email address).

We take photographs for the purpose of documenting and marketing our events and activities. This fact will be mentioned at the event and if applicable in the invitation. Such photographs are normally atmospheric photographs in which individual participants do not feature individually, but may be recognisable. In addition, participants may decide to pose for photographs either individually or in groups. On account of your participation in the event and posing as the case may be, we shall assume that you consent to us using such photographs for internal documentation purposes and for publication through our channels (newsletter, Website, social media). Should you not consent, please contact us in advance or at the event itself or send us a message afterwards as indicated below.

In relation to the receipt and processing of registrations as well as communication with you, we receive support from our partners, which are in turn subject to data protection rules, and which we have carefully selected and duly obliged under contract to comply with data protection rules, in particular in relation to data security.

2.5. If you become a customer of ours offline

In order to become a customer of ours, either you or your organisation will have to conclude a contract with us. In order to do so, we require information such as surname, first name, form of address, organisation if applicable, telephone number, email address, delivery address, invoicing address and type of payment. This information enables us first of all to assess and if appropriate establish a customer relationship with you or your organisation. Secondly, it subsequently enables us to provide the services or goods requested by you or your organisation for the purpose of performance of the contract. In addition, we create a file concerning you or your organisation, which records your contact information, work performed, transactions, communication, documents created or received, time worked and information required for invoicing and accounting. We duly store all of this information in accordance with statutory requirements.

 

2.6. If you apply for a job with us

You can apply to us by email or if appropriate via our job and applications platform. If you do so, you will be deemed to have consented to us processing your email address, surname, first name, form of address, address, all data contained in your CV, your qualifications and certificates, your references and all other data and letters that you send to us in relation to your application, or respectively that are requested in the online form for the purpose of examining your application, communicating with you concerning it and if applicable contacting your referees. You can withdraw your consent at any time. If your application is unsuccessful, we shall erase your documents after one year at the latest. In relation to the operation of our job and application platform, we receive support from our partners, which are in turn subject to data protection rules and which we have carefully selected and duly obliged under contract to comply with data protection rules, in particular in relation to data security.

2.7. If you participate in any of our competitions

We organise competitions and prize draws from time to time, both online and offline. In order to participate in these, we ask for your email address, surname, first name, and if applicable address and telephone number. Participation may be subject to additional requirements, such as answering questions or providing assessments. If you decide to participate in such a competition, you will be deemed to have consented to us processing these data in order to identify and contact the winners in accordance with the respective terms and conditions of participation. Thereafter, the data will be archived or erased in accordance with statutory requirements.

If you decide to participate in any such competition, you will be deemed to have consented to us processing your email address and your interaction with our newsletter in order to send you by email our newsletter tailored to your interests, to ensure proper receipt and if applicable to improve our offer on the basis of interaction with you. This includes usage for other advertising purposes on social media (e.g. for “lookalike” audience campaigns). You can withdraw your consent at any time with future effect via the options provided in the newsletter.

In relation to the holding of competitions, we receive support from our partners, which are in turn subject to data protection rules and which we have carefully selected and duly obliged under contract to comply with data protection rules, in particular in relation to data security. If appropriate, we shall provide you with further information in the terms and conditions of participation for the competition concerned.

 

2.8. If you follow our profile on social media

If you decide to follow our profile on social media and if applicable to communicate with us through that medium, you will be deemed to have consented to us processing your username for the purpose of administering and analysing our followers (including for advertising purposes) as well as the content of any interaction with us or with our content. You can unfollow our profile at any time with future effect.

We are responsible for the operation of such a profile alongside the operator of the relevant platform: we are responsible for the processing of your data as described above, whereas the platform operator is responsible for the processing of your data according to the terms of the agreement concluded between you and the platform operator.

3. Which technologies from which third party providers have we embedded?

We use various technologies of (other) third party providers on our website e.g. for the purpose of analysis, segmentation, marketing, embedding social media, security, media presentation, CRM integration, etc. These providers explain in their respective PPs which data they process for which purposes, for how long, with whom they share them, which rights you have and how you can exercise them. If applicable you can object to such processing by clicking on the respective links provided by us. You can also apply the appropriate settings to your own internet browser in order to prevent for instance cookies being stored on your device or tracking technologies being used. You can apply and manage these settings in your internet browser, depending on the provider, under the privacy, security or data protection settings.

4. Do we transfer your personal data to foreign countries?

We work with various partners in Switzerland and abroad (see above). As a general rule, they are situated in countries with an adequate level of data protection. Should any transfer to individual countries require additional protection, we shall ensure it by agreeing with such partners upon standard data protection clauses approved by the authorities or by requiring self-certification by such partners under the agreements concerned.

 

5. What are your rights in relation to us?

You have the right:

  • to obtain access to or the rectification or erasure of your personal data;
  • to obtain from us the restriction of processing of your personal, and in particular to object to the processing of your personal data for marketing purposes; and
  • to obtain from us the provision to you or to a natural or legal person designated by you of a digital file containing your personal data (data portability).

You can withdraw your consent to the processing of your personal data for the purposes indicated at any time with future effect.

You have the right to lodge a complaint with the competent authority (Federal Data Protection and Information Commissioner).
